Approval Route

The Foreign Investment Promotion Board has been constituted under the Department of Economic Affairs, Ministry of Finance to consider and recommend Foreign Direct Investment which is outside the purview of the Automatic Route. Although almost all sectors are under the Automatic Route,

  • Proposals requiring an industrial license, cases where the foreign collaborator has a previous venture/tie up in India
  • Proposals relating to acquisition of shares in an existing Indian company by an overseas corporate body and proposals falling outside the sectoral policy and Automatic Route have to make an application to the Foreign Investment Promotion Board prior to investing in India. Lex Valorem with its expertise in all matters relating to Foreign Exchange Management Act, 1999 and related regulations would undertake to advice on the investment strategies to facilitate Foreign Direct Investment under the Approval Route and in the manner as follows:
  • Depending on the proposed investment and the sector proposed to be invested in, Lex Valorem would assist in making suitable application to the Foreign Investment Promotion Board and on application made follow up with the authorities regarding the same.
  • Subject to the approval received, Lex Valorem would further assist in implementing the investment proposal whether as a joint venture, Wholly Owned Subsidiary or an existing Indian entity.
